GENERAL TERMS AND CONDITIONS OF SALE

Comercial Feroca, S.A. (hereinafter "Feroca")through its website https://www.feroca.com (in the front, the "Site")provides duly registered users (the "User" or the "Users")with the purchase of modeling, molding, and derivative products (hereinafter, the "Products").

The following general terms and conditions (hereinafter the "TyC") develop the particular conditions governing the relationship between Feroca and the User by the use and access of the User to the Site and the purchase of the products or services offered therein.

1- Introduction

Feroca is a public limited company, Spanish national, with registered office at Calle el Españoleto, 11, C.P. 28010, Madrid (Spain), and holder of CIF A78148699 and email address: info@feroca.com and the company is registered in the Commercial Register of Madrid, Volume 877, Gral. 850, Secc. 3a, Folio 22, Sheet 68952.

These TyCs have been prepared in accordance with the provisions of Law 7/1998, of April 13, on General Conditions of Procurement; Royal Legislative Decree 1/2007 of 16 November approving the Consolidated Text of the General Law for the Defense of Consumers and other complementary laws; Law 7/1996 of January 15 on Retail Management; Law 34/2002, of July 11, Services of the Information Society, as well as any other legal provisions that apply to the activities of Feroca and the Site.

By accessing the Website and, where applicable, purchasing the products or services provided by Feroca, the User accepts each and every one of these TyCs, the Feroca Privacy Policy,as well as the Legal Notices and Terms of Use.

If you accept the TyCs on behalf of your company or other entity, you represent and warrant that (i) you have sufficient legal capacity to link your company or entity, (ii) have read and understood these Terms, and (iii) you agree to them on behalf of the company you represent. If you don't have the legal capacity to accept such a linkage, you can't continue hiring.

2- Access and use of the Site

Access to the "Store" area is an exclusive service, intended only for those Registered Users and Feroca assets. By clicking on the "REGISTER" button displayed as part of the contracting process, the User accepts the TyCs set out in these Terms.

A User will be considered active once it has been registered through the procedures established on the Site and there is confirmation of the contractual link by sending confirmation of the registration to the email address indicated during the registration process of the Users.

The User acknowledges being over eighteen (18) years of age (with the exception of emancipated minors) and agrees that access to and use of the Site and/or the contents contained therein takes place freely and consciously, under his/her sole responsibility.

Feroca's access to and contracting process, terms and conditions of the provision of the services will be subject to the provisions of the Website at any time.

Likewise, the User, in contracting the provision of the services by Feroca, expressly undertakes to provide truthful and lawful information, assuming for this purpose all damages, of any kind, that the non-veracity or wrongfulness of the data provided by him/her may directly and/or indirectly cause to Feroca and/or any third party, at any time, for any reason, by any means and/or form.

3- Access keys

Feroca will provide an identifier and access code to the User, personal and non-transferable, in order for the User to use the services offered by Feroca on the Site. The User undertakes to preserve the confidentiality of the same, not facilitating the use of his own username and access key to third parties, and thus assuming all kinds of consequences arising from the aforementioned breach of said obligation. The access key can be modified at the request of either party. In the event that such modification takes place at Feroca's express request, the User will be notified of the date of deactivation and replacement of the access code with a new one.

Feroca is not responsible for any damages or benefits no longer obtained or caused to the User and/or any third party, as a result of the loss or subtraction of the username and access key and/or as a result of its use by a third party.

4- Prices

All prices of the products are included along with the rest of the product description, being publicly accessible, without having to be registered as a user.

Being Faroe present in several countries of the European Union, prices are shown with and without taxes included in product descriptions.

During the purchase process, the Site will detect the user's location and at the end of the process will display the final price with Value Added Tax (VAT) applicable in Spain or at its location at the time of the purchase, without prejudice to the user having at all times disaggregated information about the price of the product.

In the case of offers or promotions, the prices indicated for each product are the prices applicable to the marketing of said product in each specific promotion, taking as a reference each promotion individually, and not guaranteeing by Feroca that the prices indicated will be equally applicable in other similar promotions made at another time.

If you are interested in a product that does not appear as available, you can contact us and we will inform you of the date of entry into our warehouses. Likewise, if you need larger quantities than those offered on our Site, you can contact us and we will inform you of the price.

5- Scope of operation of the Page

The www.feroca.com provides its services throughout mainland Spain, the Balearic Islands and mainland European Union countries. We do not serve orders from islands.

In the Canary Islands we have a distributor that will serve you much faster and more effectively with the quality of Feroca materials, it is called TNK Adhesives and this is its website: http://www.adhesivostnk.es/tienda/es/

The delivery times on the peninsula are 24-48 hours from the order confirmation in Spain and Portugal. For other destinations please check with our sales on international@feroca.com

This method of delivery has associated certain shipping costs, which may be borne by the user depending on the amount of the order placed.

The information regarding the date of delivery will be clearly indicated to the user on the Site at the time of choice of the transport method during the purchase process. In any case, Feroca will put all its efforts and dedication in delivering the products purchased on the indicated date. However, in the event of exceptional circumstances or force majeure escaping Feroca's control and preventing the supply of the products within the prescribed period, to the extent permitted by applicable law, Feroca may not guarantee such delivery time, especially where the user resides in hard-to-reach or high-risk populations. However, it is noted that Feroca will in any case make the greatest efforts to deliver the products within the expected timeframe.

Regardless of the shipping option you select, the return procedure will be the same in any case, as described in these Terms of Contract.

6- Security

In order to manage your purchase on our Site, we inform you that your data will be processed by us following the guidelines in data protection that we apply carefully. The purpose of the processing is to manage the purchase you make on our Site, the management of the relationship with you as a Feroca User and, where appropriate, send you our newsletter with the news of our products. It is very important for us to protect our customers' data properly and above all that you have all the information about how we use your data, so if you have doubts about this aspect, do not hesitate to contact us in the info@feroca.com.

This is a safe place. All the information you send to the server is encrypted and can only be interpreted by Feroca. All the data we ask for will be treated with maximum confidentiality according to the L.O.P.D.

7- Use and warranty of products and Return Policy

USE AND WARRANTY

1- The information contained in the instructions and safety sheets of Feroca products is considered accurate. However, there is no express or implied warranty regarding the accuracy of the data. Since the use of this product is not under the control of Feroca, it is the User's obligation to determine the suitability of the product for its intended application and assumes all risks and responsibilities for its safe use. Feroca assumes no responsibility for misuse of the products.

2- All our products, perishable and non-perishable, marketed on the Site have the minimum warranty period legally established and will be that of the very nature of the product.

Many Feroca products are perishable and consumer products and, therefore, if they have been opened by the User and started to be used, the User must inform Feroca of the lack of conformity within two months of being aware of it. In these cases Feroca will be responding to these products, proceeding to their return and, therefore, without linking this return to the product being open. Only in the event that Feroca determines by means of a technical report, that the product is under appropriate conditions of use and that it responds to the advertised characteristics, will they let the User know and in this case it would not correspond to the refund of the amounts paid by the User.

However, given the characteristics of commercial products, customers should be mindful that these, since they are mostly chemicals, have their corresponding expiry periods, guaranteeing in any case that at the time of marketing the products have a sufficient period for their use.

RIGHT OF WITHDRAWAL

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, users are then informed of the following aspects:

All users can exercise their right of withdrawal within a maximum period of 14 calendar days from the time the product was received, having to be exercised directly against Feroca and must follow in any case the following steps:

1- The User must inform Feroca of his/her desire to exercise his/her right of withdrawal through any of the means of customer service, by writing to info@feroca.com, by calling 914481271 or by requesting it through the right of withdrawal form that can be found at the following link: Withdrawal form

2- The User must bear the direct costs of the return, informed in any case by Feroca during the process. In addition, any possible damage or deterioration of the product during transport and the responsibilities arising will be assumed by the user.

3- Any product that you want to exchange or return must be made in its original packaging, labeling and packaging and should not be handled, the material must be returned in the same condition in which it was purchased, this will be checked by the Feroca staff.

4- Once the request for the exercise of the right of withdrawal has been received, the system will send an email confirming that it has received the request. Subsequently, it will proceed to refund the economic amount paid (including, where appropriate, the costs of delivery and less the direct costs of the return if the transport offered by Feroca has been used) within a maximum period of 14 calendar days from the time of receipt of the application for the right and the receipt of the purchased product. In any case, the payment of the economic amounts will be made through the means used by the user to make the initial payment, unless the User states a different one and in which case may incur additional costs.

5- Similarly and in accordance with the provisions of the current legislation, it will not be possible to exercise the right of withdrawal in cases where products made according to consumer specifications or clearly customized are purchased, or which, by their nature, cannot be returned or may deteriorate or expire quickly. In addition, it will not be possible to exercise the right of withdrawal when products that are already unsealed are not eligible to be returned for reasons of health protection or hygiene.

8- Workshops (workshops)

1- The purchase of a workshop (course) on the Feroca website, implies the authorization to take photographs and / or videos to students during the courses, as well as the publication of them on feroca.com and / or on social networks of Feroca for promotional purposes. In the case of minors, Feroca has an authorization form, which must be filled out by the parents or legal guardians prior to the start of the course, in case you do not want to fill it out Feroca will be forced not to have the minor in the course in case of the impossibility of not including you in promotional images, in which case you would be refunded the full amount of the course. Emancipated minors can go to the Feroca Workshops.

2- During workshops it is allowed to take photographs, but NOT VIDEOS.

3- Feroca reserves the right to modify the Workshop program if the course of the workshop so requires, due to the characteristics of each group. Feroca also reserves the right to suspend a workshop for lack of students, in this case all the money will be returned to Users who have already purchased their place.

4- In the event that a student makes a purchase of a course and for any circumstances cannot attend it, the full amount of the course will be refunded to him provided that he/she communicates to Feroca during the period of 14 calendar days after the purchase that marks the right to withdrawal set out in point 7. After that period the money will not be refunded as there will be no room to look for a student to cover your place.

9- Applicable Law and Dispute Resolution

These Terms of Use are governed by Spanish law. The parties submit, at their option, for the resolution of disputes and waiing any other law, to the courts and tribunals of the user's domicile.

To file claims in the use of our services the User may contact by mail to the e-mail address info@feroca.com or by registered mail at the address of Feroca, shown at the first point of these conditions of sale, committing us to seek at all times an amicable solution to the conflict.
